TERMS AND CONDITIONS OF SALE

These conditions of sale (CGV) are concluded on the one hand by the company WHATIMISIT whose head office is located at CS 48756 58 rue de Monceau 75380 Paris Cedex 08, registered with the Registry of the Commercial Court of Paris under number RCS 927 610 725, hereinafter referred to as “WHATIMISIT” and managing the site https://whatimisit.com and, on the other hand, by any natural or legal person wishing to make a purchase via the website https://whatimisit.com hereinafter referred to as “the buyer”.

ARTICLE 1: OBJECT

These conditions of sale aim to define the contractual relations between WHATIMISIT and the buyer and the conditions applicable to any purchase made through the website https://whatimisit.com. The acquisition of a product through this site implies unreserved acceptance by the buyer of these conditions of sale, of which the buyer acknowledges having read prior to his order. Before any transaction, the buyer declares on the one hand that the purchase of products on the site https://whatimisit.com is not directly related to his professional activity and is limited to strictly personal use and on the other hand to have full legal capacity, allowing it to commit to these general conditions of sale.

The WHATIMISIT company retains the possibility of modifying these conditions of sale at any time, in order to comply with any new regulations or in order to improve the use of its site. Therefore, the applicable conditions will be those in force on the date of the order by the buyer.


These general conditions of sale are written in French. In the event that they are translated into a foreign language, only the French text will be authentic in the event of a dispute.

ARTICLE 2. PRODUCTS

The products offered are those which appear on the website https://whatimisit.com of the company WHATIMISIT, while stocks last. WHATIMISIT reserves the right to modify the product assortment at any time. Each product is presented on the website in the form of a description listing its main technical characteristics.
The photographs are as faithful as possible, they are not contractual and do not bind the Seller in any way. The choice and purchase of a product are the sole responsibility of the customer.

ARTICLE 3. AVAILABILITY

Our offers are valid as long as they are visible on our site and while stocks last.
Information on product availability is given for information purposes only and products are only reserved after payment of the order. An order awaiting payment may thus see the stock of one or more products ordered modified or zero. In the event of a failure, WHATIMISIT reserves the right to cancel all or part of the order already paid and will reimburse the product(s) concerned.

ARTICLE 4. PRICES

The prices indicated on the website are in Euros (€) all taxes included (TTC) taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. However, to the extent that the company would be exempt from VAT on sales, the products would be invoiced excluding taxes (HT). In the event of delivery to a country other than mainland France or the European Union, the price will be calculated excluding taxes (HT). Customs duties and other local taxes may be required. These rights and sums will be the responsibility of the customer and
are not within the jurisdiction of WHATIMISIT.

 

The prices indicated do not include delivery costs, which are invoiced in addition to the price of the products purchased depending on the total amount of the order. Delivery conditions and prices are
detailed in Article 8. Delivery .

WHATIMISIT reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer.

The prices indicated on the site may be modified downwards or upwards without notice and any order constitutes acceptance of the prices and description of the products available for sale.

All orders are payable in Euros (€).

ARTICLE 5. ORDER AND PAYMENT TERMS

To protect your payment information and ensure that your shopping experience at Whatimisit is safe and secure, we have implemented the following security measures:

  • protection of the site against fraudulent attacks using artificial intelligence

  • 3D 2.0 authentication system when paying by European card

  • payment processing compliant with PCI security standards

  • secure purchases thanks to HTTPS/TLS encryption

Orders are processed Monday through Friday excluding public holidays. An order placed during the weekend or on a public holiday will be processed the following business day.


Before any order, the buyer must create an account on the site https://whatimisit.com. The account creation button is accessible directly from the menu bar at the top of the site. At each visit, the buyer, if he wishes to order or consult his account (order status, profile, etc.), must identify himself using this information. WHATIMISIT allows the buyer to order and pay for their products in several stages, with 3 payment options to choose from:

- Either by bank card (Mastercard, Visa, AMEX, Diners, China UnionPay, JCB, Discover, Visa Electron, CartesBancaires and Maestro). The buyer selects the products he wishes to order in the “basket”, modifies if necessary (quantities, references, etc.), checks the delivery address or enters a new one. Then, shipping costs are calculated and submitted to the buyer, along with the name of the carrier. Then, the buyer chooses the payment method of their choice: “Payment by credit card”. The next step asks them to check all the information, read and accept these general conditions of sale by checking the corresponding box, then invites them to validate their order by clicking on the “Order and pay” button. Finally, the buyer is redirected to the secure interface in order to securely enter their personal bank card information. If payment is accepted, the order is recorded and the contract is definitively formed. Payment by credit card is irrevocable.

- Either by Apple Pay. The buyer selects the products he wishes to order in the “basket”, modifies if necessary (quantities, references, etc.), checks the delivery address or enters a new one. Then, shipping costs are calculated and submitted to the buyer, along with the name of the carrier. Then the buyer chooses the Apple Pay payment method. The next step asks him to check all the information, read and accept the
these general conditions of sale by checking the corresponding box, then invites them to validate their order by clicking on the “Order and pay” button. Finally, the buyer is redirected to the secure interface, and asked if necessary, to enter their contact details and billing information, then to confirm the payment. If payment is accepted, the order is recorded and the contract is definitively formed. Payment via Appel Pay is irrevocable.

- Either by bank transfer (offline payment). The buyer selects the products he wishes to order in the “basket”, modifies if necessary (quantities, references, etc.), checks the delivery address or enters a new one. Then, shipping costs are calculated and submitted to the buyer, along with the name of the carrier. Then, the buyer chooses the payment method of their choice: “Bank transfer”. Finally, the last step asks him to check all the information, read and accept these general conditions of sale by checking the corresponding box, then invites him to validate his order by clicking on the “Order and pay” button. This last click forms the definitive conclusion of the contract. Upon validation, the buyer receives a purchase order confirming the registration of their order. In order to finalize their payment and trigger the processing of their order, the buyer must contact their bank in order to make the transfer corresponding to the amount of their order to the WHATIMISIT bank account, the details of which are communicated to the buyer. Upon receipt of the transfer, the order will be processed and the buyer will be informed by email. WHATIMISIT will ship the products no earlier than 2 working days after receipt of the transfer corresponding to the order, subject to provisions. In order for the product to be reserved while awaiting payment to WHATIMISIT's account, the buyer must provide proof of the bank transfer on the day of the order.

Confirmation of an order entails acceptance of these conditions of sale, acknowledgment of having perfect knowledge of them and waiver of the right to rely on one's own conditions of purchase. All the data provided and the recorded confirmation will constitute proof of the transaction. If the buyer has an email address and has provided it on their order form, WHATIMISIT will send them confirmation of the registration of their order by email.

It is the customer's responsibility to verify the accuracy of the order and to immediately report any errors.


Any order constitutes acceptance of the prices and description of the products available for sale.

WHATIMISIT reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order. The company also reserves the right to cancel or refuse any order in the event of a pricing error, particularly if the displayed price is significantly different from the actual price.

ARTICLE 6. RESERVATION OF OWNERSHIP

The WHATIMISIT company retains full ownership of the products sold until full payment of the price, in principal, fees and taxes included.

ARTICLE 7. DELIVERY

Delivery costs are calculated during the ordering process. They vary depending on the destination address, the value of the watch, and the service chosen.

Deliveries are made to the address indicated by the customer at the time of the order, with tracking of the package and delivery against a signature, by our service providers Colissimo or Chronopost, from Monday to Saturday, excluding public holidays and subject to validation of payment. .


Delivery times are given for information purposes only; if these exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed. The sums paid by the customer will then be returned to him at the latest within fourteen days following the date of termination of the contract, excluding any compensation or withholding.

In the event of the buyer's absence, he will receive a notice from the service provider, which will allow him to collect the products ordered at the place and time indicated, or to reschedule a new delivery date.


The risks associated with transport are the responsibility of the purchaser from the moment the items leave the premises of the WHATIMISIT company. The buyer is required to check in the presence of the delivery person the condition of the packaging of the goods and its contents upon delivery. If the original packaging is damaged, torn or opened, he must then check the condition of the items. If they have been damaged, the buyer must refuse the package and note a reservation on the delivery slip (package refused because damaged). He must then indicate on the delivery note and in the form of handwritten reservations any anomaly
concerning delivery (damage, missing product, damaged packages, broken products, etc.) and affix your signature. The buyer must then confirm any protest in writing within three (3) days following this delivery.


Any package returned to WHATIMISIT due to an incorrect or incomplete delivery address will be reshipped at the buyer's expense.

ARTICLE 8. WITHDRAWAL – RETURN

Under article L121-20 of the Consumer Code, the buyer has a period of 14 working days from delivery of their order to exercise their right of withdrawal and thus return the product to the seller for exchange or refund without penalty, with the exception of delivery costs and, where applicable, customs costs concerning the return of the item, which remain the responsibility of the customer.
Any returns made after the legal withdrawal period of 14 days cannot be refunded or exchanged, unless agreed in writing by our customer service.


To do this, the watch must arrive complete in its original packaging, unworn, in perfect aesthetic and working condition. If any elements were missing, the item contained irreversible traces of use, or the return did not comply with article L221-28 of the Consumer Code, the customer would be notified by email, and WHATIMISIT would then reserve the right to refuse the return and return it to the sender.


After acceptance by WHATIMISIT customer service, and in agreement with the customer, the item will either be exchanged (subject to availability) or refunded by bank transfer. If the customer wishes, he will be offered a valid credit on the whatimisit.com website.


No cash on delivery will be accepted.

ARTICLE 9. WATCH GUARANTEE

All items supplied by WHATIMISIT benefit from the legal guarantee of conformity and the guarantee against hidden defects, in accordance with the provisions of articles L.217-4 et seq. of the Consumer Code and 1641 et seq. of the Civil Code.


In order to assert his rights, the customer must inform WHATIMISIT, in writing, of the non-conformity of the products within a maximum period of twenty-four (24) months or twelve (12) months if it concerns a second-hand good from the date of delivery of the items.

Then WHATIMISIT will reimburse, replace or repair the item under warranty found to be non-compliant or defective.

If bringing an item into conformity is impossible or involves disproportionate costs, its reimbursement will be made as soon as possible and at the latest within 30 days following discovery by the seller. Reimbursement will be made by transfer to the customer's bank account.

Note that return costs are the responsibility of the customer, and that to avoid any unpleasant surprises, it is necessary to insure your shipment.


The warranty only covers mechanical and manufacturing defects, provided that the material or manufacturing defects become apparent under normal conditions of use.

The warranty does not cover and does not engage the liability of Whatimisit in the following cases:

  • defects or damage resulting from accident, improper handling or misuse (such as shocks, blows, crushing, etc.)

  • normal wear or aging of components, bracelets, cases, crowns, push buttons, glasses, etc.

  • abnormal use or lack of regular maintenance of the watch

  • defects resulting from magnetic fields or climatic conditions

  • moisture infiltration into the housing and oxidation phenomena

  • non-compliance with the legislation of the country in which the products are delivered, which it is up to the customer to verify.

  • when used for professional purposes.


WHATIMISIT's warranty is, in any case, limited to the replacement or reimbursement of the non-compliant or defective item.

Any repairs carried out on a watch purchased on the whatimisit.com website must be carried out by an approved partner of the brand or by the manufacturer itself, otherwise the manufacturer's warranty will no longer be valid.

ARTICLE 10. RESPONSIBILITIES

WHATIMISIT in the distance selling process is only bound by an obligation of means. It cannot be held liable for damage resulting from the use of the Internet network such as loss of data, intrusion, viruses, interruption of service, or other unintentional problems.

ARTICLE 11. INTELLECTUAL PROPERTIES

All elements of the site https://whatimisit.com are and remain the intellectual and exclusive property of the company WHATIMISIT. No one is authorized to reproduce, exploit, or use for any reason whatsoever, even partially, elements of the site whether in the form of a photo, logo, visual or text.

ARTICLE 12. PERSONAL DATA

The WHATIMISIT company undertakes to preserve the confidentiality of the information provided by the buyer, which he may be required to transmit for the use of certain services. Any information concerning him is subject to the provisions of Law No. 78-17 of January 6, 1978. As such, the Internet user has the right to access, modify and delete information concerning him. ARTICLE 13. SETTLEMENT OF DISPUTES

These distance selling conditions are subject to French law. For all disputes or disputes, only the French courts have jurisdiction.
